Article 19

1. Freedom of Speech and Expression — Article 19(1)(a) – अपनी बात, विचार और opinions व्यक्त करने की स्वतंत्रता।

2. Peacefully and without arms assemble

क्या Freedom of Speech absolute है?

Article 19(1)(a) हमें Freedom of Speech and Expression देता है, लेकिन Article 19(2) State को कुछ परिस्थितियों में reasonable restrictions लगाने की अनुमति देता है।

  • Sovereignty and Integrity of India
  • Security of the State
  • Friendly Relations with Foreign States
  • Public Order
  • Decency or Morality
  • Contempt of Court
  • Defamation
  • Incitement to an Offence

इसलिए “Freedom of Speech” का मतलब “Freedom from all legal consequences” नहीं है।

Supreme Court

Freedom of Speech and Expression

Article 19.
