Many people receive phone calls from police officers asking them to visit the police station. Naturally, such calls create fear and confusion. However, citizens should understand that the law regulates how police can require someone to appear during an investigation.

Since July 2024, India’s criminal procedure has undergone a major transformation with the implementation of the Bharatiya Nagarik Suraksha Sanhita, 2023. This new legal framework replaced the earlier criminal procedure law and introduced several safeguards to protect citizens during police investigations.

Can Police Arrest Without a Warrant in India? Explained Simply

Police Must Follow Legal Procedure Before Calling You 

Police officers cannot arbitrarily summon individuals to the police station during an investigation. Instead, the law requires them to follow a defined legal process.

Under Section 35 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the investigating officer must issue a formal written notice of appearance when a person’s presence becomes necessary for investigation.

This notice usually includes:

  • The case details under investigation

  • The name and designation of the investigating officer

  • The date and time for appearance

  • The place where the person must appear

Therefore, a simple phone call or verbal instruction does not constitute a legally valid summons.

Protection Against Unnecessary Arrest

The new criminal laws emphasize protection of personal liberty while allowing effective investigation. Consequently, police should avoid unnecessary arrests whenever possible.

When a person receives a notice under Section 35 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperates with the investigation, the police generally should not arrest that individual without proper justification.

Furthermore, the law encourages investigators to use notices and questioning rather than immediate arrest in appropriate cases. This approach strengthens procedural fairness and reduces misuse of police powers.

Special Protection for Women

Indian criminal procedure provides additional safeguards for women during investigations. These protections aim to prevent harassment and ensure dignity.

According to Section 179 of the Bharatiya Nagarik Suraksha Sanhita, 2023, police should ordinarily record a woman’s statement at her residence or at a place she chooses. Consequently, officers should avoid requiring women to appear at the police station for questioning.

Moreover, investigators should conduct such questioning in the presence of family members or responsible persons whenever possible.

Right to Consult a Lawyer

Every individual possesses the fundamental right to consult a legal practitioner.

This protection flows directly from Article 22 of the Constitution of India, which safeguards individuals against arbitrary arrest and detention. Therefore, a person may seek legal advice before responding to police questioning.

In addition, legal guidance helps ensure that the investigation process remains fair and transparent.

Judicial Safeguards Against Misuse of Police Powers

Indian courts have repeatedly emphasized the importance of protecting personal liberty. In particular, the Supreme Court in Arnesh Kumar v. State of Bihar (2014) issued strict guidelines to prevent unnecessary arrests.

The Court clearly held that police officers must justify arrests and follow legal safeguards before depriving any person of liberty. Consequently, these principles continue to guide police conduct under the new criminal law regime.

What You Should Do If Police Call You

If you receive a phone call from police asking you to visit the station, remain calm and follow these practical steps:

✔ Ask the officer to send a written notice of appearance
✔ Note the name, rank, and police station of the officer
✔ Inform a lawyer or trusted family member
✔ Carry valid identity documents
✔ Cooperate with lawful investigation procedures

Most importantly, always maintain a calm and respectful approach while asserting your legal rights.

What to do If Police Harass or Threaten You

Sometimes individuals face repeated calls or intimidation without proper legal notice. In such circumstances, the law provides remedies.

You may take the following steps:

  • Approach senior police officials

  • File a complaint before the Jurisdictional Magistrate

  • Seek legal relief through appropriate court proceedings

Therefore, citizens should remember that misuse of authority by public officials can attract legal consequences.
